I purchased a $500 viventi road cycle called Novara sports. it has chewed up the 8th gear in a month which was replaced under warranty, now a mnth later it is slipping in this same rear 8th gear and the manufacturer shimosa and the dealer THE EDGe cycles Gosford say it is rider error and that I have to pay for a new one and the cost of fitting it! This is not fair trading fellow cycle riders! So if any one is interested in this cycle it has 24 gears and only 21 work at present. any decent offer will not be refused

I have a Novara Sport too - it is 2 years old now and I have not experienced this problem. I think you need to learn how to ride a bike and change gears properly.
Cable stretch is common on new bikes and can cause problems with gear changes. In fact, the only time I have had problems with gear changing is when the cable needs tightening - which is something you should be capable of recognising and doing yourself. If you don't have this skill, ask the guys at the bike shop to show you.

The guy at the shop says i am riding the bike as a three speed bike but I use the gears like any normal person. if the back gear, the 8th gear constantly slips from new in one month after they fit and adjust it , then it cannot be rider error. I only ride one hr a day 5 days a week and its mainly flat.

When you say the 8th gear, do you mean the biggest one at the back or the smallest one at the back? I'm assuming you mean the smallest one which corresponds to the number 8 on the shifter.
This sounds like a gear changing problem which means either something needs adjusting or you are doing something wrong.
So when you say you change gears like any normal person, what does that mean? Can you give me an example of the gear you start out in and which gears you select while riding.
Maybe you need to ride with someone else so they can observe what is happening and offer some advice.
BTW, the Shimano running gear used on Vivente bikes is not exclusive to Vivente - lots of other manufacturers use it on their low-end bikes.
