I was told you kids were talking about this.

I saw Jonny's bike after the race, it was ugly. It would have really been
bad if that was his head. I did not see either incident, however.

Mercer got suspended for 13 months from USAC, a 2nd degree felony charge, 3
years probation, and had to pay any uncovered medical bills I had, about
$600 of $25,000.

Jonny asked me what he should do, I told Jonny he should press charges just
to make sure he had things documented in case he wanted to take recourse
later. Supposedly Monex is going to replace his bike and other damaged
equipment, and Jonny was happy with that.

They don't need him to hang around and find out the verdict. Adam seemed to
me to be pretty unhappy that the fight occurred at all. He was also a great
deal more forgiving than I would have been.

You can still contact them and file a complaint (whatever the appropriate
chrge would be) regardless of "what the cops want". The work for the public,
not the other way around. It sure helps if you know how the court systems
work so you may have to hire an attorney to assist you even when the burden
should be on the public prosecutor.

Sounds good but in addition he needs to make sure assault charges are filed
against this maniac. Why would anyone think it is ok to leave an act like
this unpunished?

i got the story of the kung-fu fight in china from trent klasna's own

I'll assume that is in addition to dumping Gag. I mean that sounds
laim, "Uh, sorry Jonny for Roberto going ape shit on you, but here's a
new bike, OK?" They should issue an apology as well.

Until Adam posted, I did not know or recall what role the police played.
However, I was considering that USAC suspended Mercer for a year, so I
didn't know whether USAC factored in legal charges/findings or suspended
Mercer on their own accord. I still don't know whether legal charges
factored in USAC's decision, but very seldom in major sports are legal
charges filed when a player is fined/suspended. Did Bill Romanowski have
charges filed against him when he beat up his teammate in the locker room
last year?

No criminal charges were filed against Romo, although the guy did sue him.

One big question is why are we only hearing about this here? I heard
absolutely nothing elsewhere. Why did no one send this out to
Cyclingnews and Velonews? If you want suspensions, get the media
involved so more people know about it.

I dunno, but in hockey the police have been getting involved in some of the
really outrageous attacks. Considering that assault and battery is within
the rules (ok, you go to the penalty box) I would say that counts for
something. It seems to me that in most cases where I thought the local
prosecution should get involved, they have. IOW I do not see any scary
trends where athletes are not able to get justice.

Kunich might as well be an alias for all I know. Who are you other
than some random jackass who post to RBR? Just cause you can't google
me up doesn't make my opinion less correct. Believe me I haven't
bothered to google your name, but was able to determine you a jackass
solely based on your contributions to the news group. RVD
