EPO not illegal, but rather controlled. In other words, its not like crack cocaine which is illegal to have no matter what, but EPO can be prescribed by a doctor for illness. If you have a prescription you can use it, if you don't then it is illegal. It's usually used by people who have cancer and are on chemo or otherwise have some problem producing enough red blood cells. It is of course quite unethical to use it (or prescribe it) for another purpose than a legitimate illness and can be dangerous to your health if used improperly.
