You weren't hurt, were you? The damage to the bike is unfortunate, but
not a big deal compared to any injury.

My advice: You were in the wrong. Take your lumps and learn from it.

Riding on the sidewalk, especially facing traffic, is an excellent way
to get hit by a car. You're still interacting with traffic, but you're
outside the normal line of sight and moving much faster than walking
speed in a space where drivers generally only look far enough ahead to
spot pedestrians. Next time ride in the street on the right side, and
follow the traffic laws just as if you were driving a car. For more
information, read <http://www.bikexprt.com/streetsmarts/usa/index.htm>.

The key to road safety is to play by the same rules as everyone else,
to be visible, and to be predictable. Riding on the sidewalk, epecially
facing traffic, fails on all three points.

I'm sorry you were in an accident and I know this isn't what you want
to hear, but right now you should focus on learning to avoid such
things in the future rather than getting out of a ticket that you
probably deserved.

Given the command of language you exhibit in the above nessage, forget
trying to beat the ticket on your own. Instead, hire a sleazy lawyer to
help you; with any luck, he'll do it at no charge in order to represent you
in a civil suit claiming millions in damages.

My sentiments exactly - OP should learn how to clearly express the
facts - I could hardly understand what he is describing.

To OP: you were riding on the sidewalk, using the crosswalk, yes? If
so, did you have the "Walk" signal? If you did, you might be able to
beat it, depending on local laws.

For instance, local laws MIGHT say that if you're biking through a
cross walk, you have to walk the bike.

The laws in my state say that you cannot bicycle on sidewalks in a
"business district" whatever that means. It surely applies to busy
urban areas. But, I simply don't know.

If you didn't have the walk signal, and have a witness to that effect,
my guess is that you're totally out of luck, and should be.

Finally, only idiots ride on sidewalks/crosswalks - IMHO of course.
But you should ride on the road.

Err, ummm.......................

Only lawyers should reply... Only lawyers should reply...

The CU student had a suspended lic... no valid lic.. no insurance no
registration so under the law he was legally not suppose to be on the
road driving... so would a lawyer argue in court my ticket should be
voided?
ps Only lawyers should reply.

I was hit by a car making a right turn, he had tinted windows so could
not see him. This is a major intersection as 1k to 5k students use it
every school day the exact same way I crossed through the intersecion
on their bikes... so drivers know its one of the top 3 or 4
intersection students cross with their bikes and walking. The
intersection is Folsom and Arapahoe in Boulder Colorado. I made it to
the second white stripe and almost to the non right turn lane when he
hit my bike basket knocking my bike a foot or two. So I should of been
in his vision. He could of been on a cell phone I could not see in his
windows. He broke out his left turn lights hitting my bike basket and
I broke out a few spokes and got a new rim for $45.

This is Usenet. You don't get to dictate what sort of responses you get
to your posts, nor should you try. People can and will take the
discussion in whatever direction they choose. If you're not comfortable
with that, this isn't the place for you.

If you only want to hear from lawyers, why are you posting in a cycling
newsgroup? While there might be people here who happen to be lawyers
and one or two might even be licensed to practice in your neck of the
woods, I'd be very surprised if any such people felt like giving you
free legal advice.

If you're determined to fight the ticket and don't have the know-how to
do it on your own, you need to talk to a local lawyer who deals with
traffic cases rather than asking for help on the Internet. Make sure you
have your checkbook ready.

Dude, the fact that he was in the wrong doesn't mean you weren't.
Did he get a ticket? He should be jailed. The fact that hundreds of others
did something illegal as well doesn't stop it being a ticketable offense.
Lastly, if you want a lawyer, post in a lawyer's forum. This is bicycling,
just about everybody here thinks you were dumb and making other cyclists
look bad.

Try: misc. legal or misc.legal.beagles

If Osama Bin Laden was driving the car, no license, car stolen, in
this country on a false passport, the trunk loaded with a briefcase
wmd and you are at fault-- you still get the ticket. Further, what
about someone from say, Coal Creek, CO who has never been to Boulder
before and knows nothing of the 1-5K of students that "cross with
their bikes and walking?"

You got a ticket becasue you were somehow in the wrong. Riding a bike
in the roadway, even while on a crosswalk, makes puts you in the same
classification as a car and you have to follow car rules. Apparently,
you were coming towards him which is basically equivalent to a car
driving down the wrong side of the road. It doesn't matter if a
million cyclists a day do the same thing.

Then hire a lawyer. Then hire a lawyer.

This is usenet. You get what you pay for.

If you were violating the law, you were violating the law whether you
got hit or not.

Is riding the wrong way in a crosswalk legal there or not? If it is
illegal, be glad the ticket is all you got -- riding against traffic is
a good way to get killed.

> ps Only lawyers should reply.

Then go pay for a lawyer. Or at leat try a legal newsgroup, though you
likely will get informed non-lawyers rather than lawyers there, too.

1) Don't ride in a cross-walk

2) Don't ride the wrong way against traffic. Didn't your mother tell
you "If all the other kids were jumping off a cliff, would you want to
do that, too?"

There is no law concerning riding the wrong way on the sidewalk. If it
is legal to ride on the sidewalk, then you can do it either direction.
If riding on the sidewalk is prohibited there, which I believe it is,
then you were riding illegally; however, that is not the ticket you
received, so you may be able to bust out on a technicality. I think a
lot of those students you saw were high school kids, do not model
their behavior.

Jalino's Pizza still there? Fond memories of that place.

He wasn't on the sidewalk. He was on the street (in the crosswalk). Once
he's on the street with his feet on the pedals, he's not a pedestrian
anymore.

Don't know what the law is where you live, but in Ontario it is
ILLEGAL to ride a bike across a crosswalk. IN EITHER DIRECTION.
