The gut was deemed to be a legal aero device though by the UCI.

 
Meh, Tour titles stripped huh? I guess he's still got his 93' World Championship where he rode away from the best cyclists of the era: Indurain, Chiapucci, Musseuw, Riss, et al. It's been told in the media he's been a jerk in his personal life, so what? I'd say Cheryl Crow's as good an excuse as any. He's also affected some very sick peoples lives, albeit in many cases intangibly, for the better. Life will go on for good ole Lance with his remaining endorsements and millions. One's personal feelings for the guy are irrelevant. His impact on the world for the positive will likely far exceed any of that from his naysayers or his worshippers alike. Cheater or not, he's still the greatest TDF rider ever. That seems to be Merckx sentiment. I tend to be in agreement. My take on it is that he may be a bit of a jerk, but as I mentioned one's feelings are irrelevant to the bike racer that LA was..

For me the whole current debacle can be summed up in two key phrases from probably the only impartial person that's actually seem any of the "evidence", US District Court Judge, Sam Sparks:

"The Court noted during the August 10 hearing, this "charging document" is so vague and unhelpful it would not pass muster in any court in the United States. The Court is assured, however, that Armstrong will be given adequate notice of the specific allegations against him in a timely fashion prior to arbitration, and proceeds under the assumption this will actually occur.

Quote: Sparks’ concerns and subsequently delayed ruling on [COLOR= rgb(0, 102, 204)]jurisdiction[/COLOR] were primarily based around the specifics provided by USADA, or rather apparent lack of which did not provide Armstrong with enough information to mount an adequate defence.

"I couldn't find anything but conclusions (in the charges)," Sparks said. "Not one name, not one event, not one date,” said Sparks.


Who needs hard facts and proof when you have a whole decade of Internetz evidence! Say it enough, it seems, and it becomes fact.

Yes! What good would it be to have a Socialist nation.... if they/we had laws that applied to everyone. The USADA has shown the way forward into into a centralized enforcement of laws made up by [and for the benefit of] bureaucrats. Instead of by elected politicians that have to answer to the voting public.

Where there is money... you will find crooks and Government tax collectors. Or.... is that just a redundant statement? The USADA is applying force to cycling.... and the full intent is crush the sport... or at least wring money from it.

You are... of course... absolutely correct. And the "doping" infraction that he is now being accused of isn't even using "dope" in a true sense of the word. They "think" tests may have shown that his blood "may" have been reinforced with blood withdrawn at an earlier time..... ON TWO OCCASIONS. Even if we assume they are correct (without even a retest... like my own doctor would do on a disturbing test result)... they want to strip all titles... not just the two wins of the two contests? This is wrong. The sport needs to turn it's back on the USADA.

and truth be told, that summation with which you begin applies equally to armstrong's protests, except he and his agents are the sources for those rumours.

and, yes, judge sparks admonished the usada for its charge letter. not surprising and not the only side in that courtroom to feel his lash. usada also stated that, should armstrong choose to face the charges, the usada would supply the complete charge, but in the meantime sought to protect their witnesses from armstrong's usual practice of phoning them up in advance. in fine, armstrong ducked and ran rather than face the accusers.

as for "hard facts and proof", you and i alike will have to wait for those documents to be made public after those others under charge have their days before the panel. and honestly, citing a "whole decade of internetz evidence" is tacitly condemning a whole decade of armstrong's "never tested positive" dodge. he's been saying that for ten years and has surrounded himself with many believers. truth be told, we all know that the tests can be gamed and we can all remember lance and his long shower with the doping control officer held at bay by bruyneel in the driveway from a few years back.

Truth be told, the initial burden of proof is on USADA and the UCI. They have to bring forth facts and evidence that are indisputable. If those 'facts and evidence' can be disputed then there's no grounds for prosecution.

As previously mentioned, the US District Judge stated that due to the lack of facts, there was no way that Armstrong could even begin to defend himself against the USADA.

So those that we trust to uphold the sport (UCI) and those that we trust to ensure that all sports have an equal and level playing field (WADA and its country subsidiaries) are allowed to stack the deck when presenting evidence to an athlete under suspicion and not present all the evidence? You really believe that? If that's the case we have either a Kangaroo court or a Witch Hunt. What'll it be?

It shouldn't matter who the athlete is, the same rules should apply to all, otherwise we don't have a fair and just system.
