Why does Landis' suspension begin Jan 07 instead of after the '06 Tour when he stopped racing? Doesn't seem fair. Either they should let him race until he's found guilty or his suspension should be completely retroactive.

His suspension date is from the time he filed his voluntary non-competition form, which he didn't do until January. Of course then he raced the NORBA Leadville Mtb race, in the spring '08.
Fair would be starting his suspension on that date or even later since he violated his voluntary non-competition agreement.
He will probably have to appeal to CAS to get them to back-date his suspension. Didn't get the break that Basso got with CONI when they ignored his competing in the TofC when they back-dated his suspension.

I believe you're not allowed to race after the A sample is positive, unless the B sample comes back negative. Certainly not after the B sample is positive too. Plus Landis was already found guilty some time last year when USADA upheld the results of the positive dope tests. The decision that was just made by the arbitrators was Landis' appeal of that guilty decision.
I assumed Leadville was a private event, not one sanctioned by USA Cycling. Why wasn't he barred from that event? Hamilton was barred - under threat of sanctioning all USAC members - from the race in Boulder during his suspension, right?
i'm sure you get consideration for just admitting that you did it and saving everyone the time and expense of a hearing and an appeal, maybe another appeal... you drag everyone though the process and it still gets upheld, they are usually going to throw the book at you...

I've read it was a NORBA event and they tried to get unsanctioned or something like that so Landis could race, but it ended up as a NORBA event and Landis raced anyway
