What do you think of these suggested reforms?
o Full Recovery for Economic Damages- Patients who are
injured as a result of medical malpractice should be able to
recover fully all economic damages.
o Limitations on Attorney Contingency Fees- Sensible
limitations on attorney fees mean that a greater proportion
of the award goes to the patient.
o Periodic Repayment of Future Expenses or Losses- Provide
for payments of judgments over time rather than in a single
lump sum, to ensure that appropriate payments are there when
patients need them.
o Establish Uniform Statutes of Limitations- Ensure that old
cases cannot be brought years after an event, exceptions to
be made for children.
o Collateral Source Reform- Reduce the amount that doctors
must pay if a plaintiff has received other payments from an
insurer to compensate for their losses.
o Joint and Several Liability Reform- Provide that
defendants pay judgments in proportion to their fault.
