BTW, Churchill's quote is still correct and Thatcher's commentary on socialism even more so.
Fact: website has zero blame/responsibility in velocity assisting Darwin. - That is your assumption and what is being disputed.
Where is the evidence?
I'm going a hill really fast and I'm going to set a record and I'm going to post my results and I'm going to be King of the Hill.
A whole lotta 'I's" in there.
Fact: Lawyer sniffs five years worth of boat payments. - Do you have evidence for this plan?
"It will not be a small amount."
Like I said, if all that money gets donated to Cyclists Proven To Be Terminally Tarded" I'll go into a monastary. Or maybe a nunnery!
A Strava.com spokesman sent KTVU a statement Monday that read in part: "Based on the facts involved in the accident and the law, there is no merit to this lawsuit."
No foolin'? It'll only cost them a metric ton of money to get that reality established.
Meier admitted cyclists like Flint need to ride responsibly.
Why? Why bother when the team of lawyers can sue everyone NOT responsible?
"Is our client's son absolutely innocent of everything? We're not saying that," said Meier. "But we're saying Strava has got to change it's ways."
Why? Because people do stupid things?
Hell, if he had put his final ride video up for the producers of "Jackass", he would have been handsomely paid for his decision making.
"Can't we just settle this thing?"
ABC7 News legal analyst Dean Johnson calls the lawsuit a stretch. He said, "If the theory is that Strava could have and should have seen the dangers on these courses, then the cyclists who were actually there certainly could have and should have seen the same risks."
from the first 5 comments on the article:
"I know you need to find a cause and a reason, but it's clearly Kim's fault and Kim's fault only."
"Prior to the law suit I would have seen this as a tragedy, but now it seems this is a good thing, because at least the "everything is someone else's fault" genes have f..."
"This lawsuit is absurd! The loss that this family is dealing with is unfortunate, however, to allege that anyone or anything other than the cyclist himself is responsible is entirely ridiculous! Hopefully the court will throw-out/dismiss the lawsuit for what it is, which is frivolous!"
" If he was foolish enough to keep trying to beat a record on a website, that is his, and only his, fault."
"It's a shame that a-holes like this family continue to blame others and force closure of events that can't afford the insurance premiums because of lawsuits like this."
More common sense there than some of the replies here...
On the bright side it fits in with your prejudices and gives you something to rant about. /img/vbsmilies/smilies/smile.gif So that should make you happy.
I readily admit my prejudices. I make no bones about them,
I hope Strava has the brass to fight the suit, to counter-sue AND to sponsor a Fastest Cross-Manhatten at Rush Hour Ride contest on fixies without brakes.
God knows this nation is full up with enough idiots to take up the challange.
There's no discussion to be had when people throw around slurs like "libtard". Such slurs indicate the person (or people) have no interest in listening or actually engaging in fruitful discussion. You are correct in that nothing is known of the family's motivations (I stated as much earlier), and very little is known of the facts of the case. Let's face it though: facts aren't important since so many are willing to make up their own. I believe it was said somewhere that the deceased rider has created the segment on which he was trying to regain KOM status. It's difficult to see, if that's true, how Strava could be seen as being even partially liable, but again, all the facts aren't in. I do think the reaction to the story is way overblown. After all, lawsuits like this or even remotely similar to this have been filed for decades. It's nothing, and it's something that is likely nearly as old as civil courts. When I was working as a skydiving instructor in 1987,88, and 90, liability was always a concern and was often the subject of articles in our sport's magazine. There stories then of old lawsuits wherein a balloonist sued a dryer manufacturer for not stating his hot air balloon envelope should not go in the dryer, and another gent sued a ceiling fan manufacturer for not having a label on such fan stating he shouldn't stick his infant's head in the fan. We do hear more of this stuff because there are more people and the internet is great at spreading such news and stories.

I'm certain the five folks that used common sense to comment on the article and I could have a wonderful discussion as to 'who' is and 'who' is not at fault for this event. I suspect agreement would be at 100%...non-scientifically surveyed, of course.
Again, I make no bones about life's morons. None what so ever. He's dead, Jim.
...and very little is known of the facts of the case.
WTF kind of statement is THAT? What, EXACTLY, is it that you don't know that affects 'who' was responsible for bombing his bike off the side of planet earth? Tell me you're off your meds.
Haven't you read a anything about the case? This isn't the LHC's search for the Higgs Boson, for God's sake.
Man attempts to use gravity to go fast.
Man fails in epic fashion.
Lawyer wants cash from intarwebz electrons to sooth over the butthurt family has for procreating a blameless, near genius EE son.
Everyone else...nay, ANYONE else is responsible except the nut holding the handlebars.
Did I miss anything?
Let's hear it. Exactly 'what' don't you know? The color of the chamois .002 prior to impact? It was crap brown.
And people wonder why the fracking world is beyond saving.
I suggest you guys join together and get a class-action suit going. Oh wait! You can't! You don't know enough.
Oh well, I'm sure there's a large descent near you with a stop sign at the bottom...better get practicing. It'll help you get your 'facts' straight on who to blame when you slam on your brakes and burn in.
You can never tell what will come up in court. Before he had his day in court, OJ looked pretty guilty too. Yet he was found not guilty. That's the price we pay for our legal system where money can make the difference in the kind of "fair' trial you get.
There are lots of cases that are questionable and society somehow survives. Did you not see my reference to the $67 million dollar case of the lost trousers? Why get so hung up on this one? It will probably go away quietly and is not some kind of sign of the apocalypse that you make it out to be.
A human that is a hypocrite? That surprises you?
Sure you feed and care for a wild animal for long enough... and it will likely become domestic. We have many very domesticated humans around here too. But I think most of us still maintain an edge of Feral self-reliance... even if it is only imaginary. My father, my brother and myself have all fought to protect us all from the threat of Socialism, Fascism, and Communism. It would be difficult for me to see a benefit.... to a loss of liberty.
If these peole have a reasonable suit with merit and it makes it way into court who cares? My life wont change one bit. If for some reason I ever find myself dealing with the loss of a loved one and feel that someone or something was the cause of that loss I will be thankful for living in a nanny state.
You can never tell what will come up in court.
This is true, but unless Strava was using Hypnotoad in subliminal suggestion mode there is NO WAY I could logically assign any fault to them. Really. It's that damned simple.
Hmmmmm? I wonder if I code the animated gif version in subliminally if I could actually get therm to do a trampoline vault into a woodchipper? Worth a shot, I suppose...
Before he had his day in court, OJ looked pretty guilty too.
Uh...he looked plenty guilty AFTER his day in court. MarshaMarshaMarsha screwed up, Mark screwed up and the Dancing Ito screwed up. Big time. None of that merits a millisecond's brain function as to where the fault was in that case.
No one, AKAIK, tried to fault the glove. Or the knife. Or the book O.J. read the week before he took up slashing. Amirite?
Yet he was found not guilty.
Which is not the same as innocent.
That's the price we pay for our legal system where money can make the difference in the kind of "fair' trial you get.
We have the best legal 'system' money can buy! And I'll gladly send a Jackson to Strava's defense fund.
Still, all the above is mental masturbation.
Either a thinking human being claiming to have brainwave activity capable of comprehending Dancing With The Starz believes that it is even POSSIBLE a website is at fault for some dude biffing it or that it is impossible. Frankly, one of those two groups is insane. Bonkers. Around the bend. Whacko. I'll let you choose which group that be.
Now...I'm still waiting for what it is we don't know (it's...unknowable!) that makes Strava at fault. Gotta be Hypnoto...All Glory To Hypnotoad! All Glory To Hypnotoad!
There are lots of cases that are questionable and society somehow survives.
And it ends up like this...with folks actually suggesting that Strava could be at fault. That's NOT my society. And it never will be.
The same libtards that banned Lawn Darts. And insist I wear a seatbelt in my car with 11 airbags, crumple zones and 5,500 pounds of battering ram protection, but allow me to ride my GSXR-1100 helmetless, sans any seat belts or airbags at speeds I swear I HAVE seen the Higgs particle. Insane? You damned straight it is, Skippy. No. Common. Sense. Or...just no sense at all.
As I said...NOT my society.
Why get so hung up on this one?
Because any excuse to spotlight libtard nanny state stupidity is a good one. And this thread is a veritable 250 lumen Surefire weaponlight of stoopidity. The playas all come out of the woodwork in Passion Play precision mouthing the same moronic crap over and over and over.
Then they get all butthurt when called on doing exactly what they claim NOT to be doing.
Why get so hung up on this one?
Frankly, the moronic responses posted here are reason enough...but, it is a bunch of cyclists...edification will not occur. My bad for even posting the damned article in the first place, I suppose. When the commentary section of a fracking news website offers more logical and rational remarks than here...well, that's all screwed up and predictable at the same time. After being back here for a few months I should know better.
It will probably go away quietly and is not some kind of sign of the apocalypse that you make it out to be.
If it does get tossed...and I believe it will...I will trumpet that ruling from the rooftops.
And despite your pronouncement, the simple fact that there's a supposedly educated moron or three out there with the brass to file such tripe is more that enough evidence to add this to the landfill of thoughts the Four Horsemen will ride over.
It is just one more sign society is FUBAR.
I may have my prejudices and bias, but I ain't going to fake that I like libtard fools.
Doesn't it affect us all? I mean... if it was to become too great a [libel] risk to advise [or be held responsible for the advice posted] on a Web Site then even this forum could disappear. How can a free and open exchange of information and opinion take place... if legal actions hinge on every typed thought?
And what of the additional costs of litigation built into the price of everything we buy... or wish to buy.
I think this is the basic discussion that is taking place in every diner, bowling alley, bar, coffee shop, and whatever in America. We are at a crossroads....
You seem to be able to say it so well...WITHOUT pissing people off.
My problem is that I've long passed the crossroad you refer to and I just don't give a flying fig what the idjuts think about me and how badly I piss them off.
You are correct, the costs and reactions to EVERY legal action...justified or fantasmagoric...is evident in every aspect of life. Just look at the plethora of orange "For the Tards" safety warnings that appear on everything from a lawn mower to a motorcycle to...the bicycles we ride. It's built into the price tag of everything we purchase.
It affects the availability of products we need to buy from OTC cold/allergy medicine to explosives to lawnmowers that actually discharge grass to solvents that actually work to...everything.
"It'a NOT My Fault!"
The libtards rise to stand erect on their hind legs, stiffen their spines and bristle as they hiss, "It's not a nanny state event!" "It has no affect on my life!" "You are prejudiced!"
Well no shiite? I most certainly AM! I'm tired of paying for this crap and I'm tired of listening to more and more libtard whining about making life 'safe'. The unintended consequence of which is that more and more libtards are now able to cheat Darwin and achieve breeding age to further pollute the race with the stoopid.
May your chains rest lightly upon you as the avalanche of incidents like this continue to have no effect upon your lives, your society and the world you cycle thru.
"Not a nanny state event!"
Indeed. The average Smelt is more aware.
Well, off to the store where my unaffected life starts with a "Watch Your Step" painted on the Safety Yellow curb for the terminally stupid, a "DANGER! Automatic Door!" for the retards and if I'm lucky some 400-pound, 48" wide, aisle-blocking, smelly "disabled" person on an electric shopping scooter won't manage to crush me to death as she reverses her direction of travel thanks to the 120 Db "BEEP! BEEP! BEEP! of her reverse gear warning horn.
Of course I will carefully and studiously read and compare the safety warnings on the product I'm looking for...right before I go out into traffic and play around on my 16-pound piece of plastic bicycle...
Nope...not a nanny state we live in. No way is it getting worse.
And it is entirely plausible there is some as yet unknown 'fact' that would somehow magically make a website 'responsible' for the actions of a human being that was supposedly capable of independent thinking...
Righto. I think I understand now. Thank you all so much for enlightening me. I really appreciate the life lesson. Honest.
Thank you, alienator, for inserting a shred of intelligence and sound judgement into this discussion.
While at first reading I'm inclined to dismiss the plaintiffs' charges, I admit to having neither the authority nor sufficient knowledge of the fact to pass judgement. I do know, however, that it's their right to make a case and have it heard.
I would prefer not to piss people off... most of the time. I generally try to keep my cool.... but way too often I have failed at that, myself.
The cultural wars haven't really hit us completely... yet. And maybe they never will, or maybe the actual "war part" [with the guns, and shooting, and killings] will be some time after I am gone. I really hope I don't have to be a part of such a conflict. But if it happens it happens... once again [or is it: as always] a target will be just a target. I feel confident the lazy, dependent, whiners, won't win a single battle that isn't fought by lawyers.
OK...it's Sunday morning. My legs are shattered from yesterday, but I'm sure someone's up for a quick game of "Let's Blame the Staccato Flow of Electrons Thru a Wire!".
Perhaps a lightning round of "It's All The Fault of that Software Code Writer!"?
I know it's early, but jeez...at least a quick hand of "That Mean Old Cyberbully on da Intarwebz Made Me Do It!.
Allrighty then! I'll deal you in for a few hours of "Transistors, Silicon and Gallium Arsenide Cause Death and Mayhem!".
Dueces and Speed Limits are wild, double points for playing the Race Card and Darwin gets first deal.
OK, what it is you 'knowledge deficient' folks found out that makes someone sitting at a keyboard responsible for the flying down a hill out-of-control? Surely there's some really heavy 'facts' out there you've discovered since your interest in this moronic lawsuit is so high.
Like "The pen is mightier than the sword.' Are there any other groups or policies that you feel is ruining our society or is it just some low level frivolous law suits that you want to scapegoat?
I have much bigger fish to fry. As an owner of a coal mine I hate that those libtards won't let me use children in the mines any more. It's character building. And what's up with all of these god damn mine inspections and safety gear I have to deal with?
