Reopening Puerto: DNA checking allowed to voluntary

That's an interesting development. This will allow some riders who are truly innocent to clear their names. But if some riders do volunteer their DNA to clear their names, it will cast suspicion on riders who don't volunteer, and who knows, race organizers may use these as excuses for excluding such riders. Let us see what Contador does. Isn't he one of the persons who volunteered DNA in the past?

It will also allow those who did use Fuentes but know that they used up all the blood they had stored to "prove" they are innocent. The spanish authorities need a complete analysis of all of Fuentes papers, computer files, and bank records.

Agreed Bro. But do you really think that the Spanish authorities will get their asses moving on analyzing the computer files? I'm a bit skeptical of that. They may do a half-hearted job, nail a few scapegoats to convince the public, and then go back to status-quo.

The spanish authorities will probably do whatever it take to let Contador and Valverde get away with working with Fuentes.

Meanwhile, a poor SOB like Hamilton could have his blood tested, knowing that Fuentes was busted two years after Hamilton stopped working with him. None of his blood is likely to be stored. But he will still have OP hanging over him because of the doping records. It does not seem like there is any way for Hamilton to get out from under OP short of confesssing.

I don't see why the french authorities don't charge Fuentes with something like conspiracy to commit fraud. Basso has admitted that was what he intended to do. They should file charges against Fuentes and lean on him to reveal everyone he was working with.

Very true, but that would let the cat out of the bag for the other sports. I think the Spanish authorities would look for a way to prosecute Fuentes and co. without causing any further furore over the athletes (especially the Spanish athletes) and the possible flow-on effect.

French can only charge people for action on our soil, or our citizens for bad actions around the world.

Basso and Fuentes were conspiring to defraud the Tour de France out of prize money.

entirely a supposition on this angle, but if fuentes used a french bank account or, perhaps the transaction were begun using a french bank account would the surete have an opening to ask for a look at the files in the spanish police station?

We French can resolve all big world problems, you just have to vote for the greatest of them :

Don't vote republicans, (it could be stupid gwb twin)
Don't vote Hilary
Don't vote Obama

VOTE POULIDOR
as US PRESIDENT!

In saying all that... remember Basso always said 'you' can test my DNA as part of an investigation thinking that an Italian investigation would never start..... Conador said much the same..... now would he volunteer ? Would he make the statement.. Astana should be allowed in the Tour because I'm giving my DNA ? He wont do it because I know, he knows it and Bruyneel knows it.... Astana for Tour argument over.

Let Levi **** ?

There was a generic fraud case.

Those cycist won prize money doped. That was against specific publicised rules. Surely that qualifies under numerous fraud statutes.

Alas, it is all about political will

Valverde's chances of winning the Tour just went out the window. It is only a matter of time before the ASO demands that riders suspected in OP get a DNA comparison?

Yup. If France truly is worried that the doping will harm one of the greatest tourism advertisements in the world then they should charge people with ordinary financial fraud. Aside from getting to the bottom of OP, it would increase the risks for getting caught doping.

You cannot charge someone for fraud without proofs. If the second of the race was charging the winner, probably something could be done. But probably the first would done the same against the second, the third ... but not directly against Fuentes.

For Fuentes, it's necessary to find a fault in France like illegal transportation of blood, illegal transfusion, help to rider for doping, ... Probably of this work was done by his accomplices.

Also, remember judge Ghislanine Polge's words in the Cofidis case, when they tried to seek damages for harm to their image, and the claim was dismissed:

"Through its involvement in professional cycling, its established knowledge of doping and the absence of significant measures to eliminate it, Cofidis could not have been unaware of the well-known doping phenomenon or of its magnitude."

Riffifi inside Spanish federation...

The president of the Spanish federation on the case criticized Puerto

The end of the mandate of Fulgencio Sanchez is certainly no sinecure. The president of the Spanish Federation is this time violently attacked by his vice president, Angel Saenz, who submitted his resignation. He accuses his main attitudes toward Puerto affair. The words used by the person who is also the head of the federation of La Rioja compete virulence. Sanchez, for his "behaviour" and his "darkness" was "an evil irreparable." That attitude would have left cycling in "critical condition" and caused the disappearance of teams, unemployment and many riders great economic hardship for their families. The attack turns settling scores when Saenz believes that each of the interventions of his superior was accompanied by a "feeling of terrible ridiculous." Sanchez, who did not run for re-election, will complete it in a deleterious.
