<p>The UCI confirmed Wednesday it will not seek a temporary suspension against Katusha despite the EPO positive of <a href="http://velonews.competitor.com/2015/08/news/katushas-giampaolo-caruso-positive-for-epo_381741"target="_blank">Italian rider Giampaolo Caruso</a>, revealed Tuesday after re-testing of samples taken in 2012 using new detection techniques.</p>
<p>New, stricter rules introduced this year outline that teams can be suspended from 15 to 45 days if there are two doping positives within 12 months. Luca Paolini <a href="http://velonews.competitor.com/2015/07/news/paolini-out-of-tour-after-testing-positive-for-cocaine_377607"target="_blank">tested positive for cocaine </a>in late June, but UCI officials confirmed that Caruso’s case, which stems from a 2012 sample, will not be counted against Katusha in 2015.</p>
<p>Here’s what the UCI released Wednesday: “This is based on the non-retroactivity of law principle, which is enshrined in the World Anti-Doping Code (25.2). According to the code, an Anti-Doping Rule Violation (ADRV) that occurred prior to 01.01.2015, shall be governed by the substantive Anti-Doping Rule (ADR) in effect at the time the alleged ADRV occurred. 2012 ADR did not of course provided for the team suspension.”</p>
<p>In short, that means a case originating in 2012 will not be applied in 2015.</p>
<p>Italian team Androni Giocattoli-Sidermec is currently <a href="http://velonews.competitor.com/2015/07/news/androni-giocattoli-sidermec-suspended-30-days-for-second-failed-test-of-2015_380011"target="_blank">serving a 30-day suspension</a> in what’s the first application of this new rule after two of its riders popped positives this season.</p>
<p>Wednesday’s UCI clarification will come as good news for Katusha captain Joaquim Rodríguez, who will line up Saturday as one of the podium favorites at the 70th Vuelta a España.</p>
<p>Caruso, 35, tested positive in a sample taken in March 2012, in an out-of-competition sample collected between Paris-Nice and the Tour of the Basque Country. The sample was re-analyzed using new scientific methods in what’s an important new weapon in the anti-doping effort in back-testing old samples.</p>
<p>There was no immediate comment from Caruso, who has the right to request a test on his “B” sample. Caruso raced the Tour de France and was to be part of Katusha’s Vuelta squad. There is no word yet on who might replace Caruso for the Vuelta.</p>
