Depends. If he unlawfully deprived the rightful owners of the bike and
their car with proper intent under the state criminal code, he would be a
thief regardless of whether or not he later returned the stolen goods. He
would probably just avoid prosecution. Perhaps he knew people we spreading
the word and decided it was time to cut his losses. What I'm getting at is
that the OP's statements may in fact have been truthful when made.
 
I tried googling for the defamation and it does not seem to come up
(yet)...but just enter the subject's name and "Flagstaff" and you get
the name of a bike racer from Albequerque NM who rides for Flagg Velo.

Laura, you are absolutely right about the defamation, as I have worked
for firms that have ruled-out job candidates based solely on
information that came up through google searches.

Makes it sound like someone's armed and dangerous.

I opened the thread expecting to read about a road rage driver going
around running cyclists off the road.

Counselor, in any defamation action you must plead with specificity the
exact statement(s) that are alleged to be defamatory.
"Warning to Southwest USA cyclists (especially Flagstaff)" is not defamatory
on its face and may not be defamatory in relation to the other statements in
the posting if the statements accompanying it are true.

Which shows that it is not defamatory on its face. IMO, you're still a

AT admits:

- Being premature in his statements
- Not actually knowing if the subject had skipped town when he made the
statements telling people to be on the lookout for him
- No direct knowledge about debts

He said that the subject was skipping town, and in fact he did not. So
this statement was untrue, and he should be held liable for calling
attention to it.

I made a mistake; I've done everything I know to correct it. For his
sake, I would greatly appreciate it if the subject's name was snipped
from future quotes and posts.

Well, if you tell him now, and nervously wait 364 more days, you might
not get sued. That is unless the statute of limitations applies to
when the damage is done (as in not being granted employment because of
the libel).
 
Yeah, it's not like Jesse Schafer stole $5000 from us like that
criminal Dave Fuentes did.

Ok, I live in New Mexico, and Matthew was just relaying what
a guy wrote to the NM bikeracers email list, the guy who originally
wrote the list about this guy is a racer, race promoter, and well known
and well liked
guy in the state, so Matthew was just repeating what he heard -
probably not a good
idea but I can see how it could happen, when I read it I didn't doubt
it was true at all.
the truth - it turns out - is somewhere in the middle in this story -
jesse schafer
is not a com-man criminal on the run, but he did move here last winter,
got a job at a
bike shop, ****** some people off and is moving away oweing quite a few

people some money.
he stood up and addressed the situation - I was impressed by that.

If oweing money and was a crime, I'd have been put in jail for life
years ago.
None of this is any of my business, but none of us really know what
we're talking
about - but Matthew was just passing on some info he read on a listserv
- it was
kinda dramatic weird APB type stuff.
I think anyone reading this thread will understand the situation - but
yeah I

On any regular message board, one can potentially delete posts (given
that you can reach the person who maintains it), but where you are now,
is the original USENET (that all current existing website message
boards are based on). These messages are never deleted or taken down.
There is no one to take them down. The archives just keep growing and
growing, To get these posts deleted, you'd have to pull a "Dr. Evil"
and topple the internet.

high on any internet search a propspective girlfriend or employer might
do. Next time think about what you say before doing it.
 
wait, I thought i was on FIDONET?
i use google to post on RBR and they have something where you can
delete posts, I don't know how to use it or if it works or what.
 
I'm looking around the groups.google.com interface and see no way to
delete posts (only the ability to edit before posting). If you know of
a way to delete stuff, then tell me, because I'd spend the next week
deleting all my old **** (when I used to use my name). But I don't
think you can do that though.

Well, even if you could go back and delete all your old posts from the
group rbr, it's all been picked up and posted on various things like
cyclingforums (calm down, Ewoud!) or totalbike (among several). And that
stuff is cached, so anything you said back when is going to be around in
one form or other untl Google's computers all crash.
