    They just affirmed a Ramsey County judges opinion. It will go to the
    State Supreme Court next. Nothing has changed for the last year since
    that earlier ruling. Those that got their permits still have their
    permits and those who wish to apply now do so under the old law.

    Court of appeals rules state conceal-carry gun law is unconstitutional

    The state Court of Appeals agreed Tuesday with a Ramsey County
    District Court judge that Minnesota’s conceal-and-carry gun-permitting
    law is invalid because of the way lawmakers passed it in the spring of
    2003.

    Legislators violated the state constitution’s single-subject rule when
    they lumped the gun-permitting statute with a natural resources bill,
    the three-judge panel ruled in a 26-page opinion.

    Tuesday’s ruling affirms Ramsey County District Judge John T. Finley’s
    July 2004 decision that invalidated the law. More than two dozen
    church groups and the city of Minneapolis filed suit challenging the
    2003 gun permitting law.

    The 2003 law required the state’s 87 sheriffs grant gun permits to
    most law-abiding adults compared to the previous law that required
    people to demonstrate a need to carry a handgun for their job or
    personal safety. Since Finley’s ruling, law enforcement has been
    issuing permits under the older, more discretionary law

    Gun advocates and the state attorney general have argued that
    lawmakers didn't dupe the voters when they passed the
    conceal-and-carry law as part of a natural resources bill because the
    gun bill generated more media attention and debate than any other
    measure during the 2003 legislative session.

    Lawmakers correctly tied the conceal-and-carry bill to rules on
    snowmobiles, fish houses and parks fees because they were all
    government regulation of potentially hazardous devices, Attorney
    General Mike Hatch had argued to the Court of Appeals.

    But gun opponents argued Minnesota’s 2003 gun law was doomed the day
    it was passed because lawmakers who supported it relied on a
    controversial parliamentary maneuver where they attached it to an
    unrelated bill, forcing the gun law to a vote in the
    Democrat-controlled Senate. Up until that point, the gun law had
    stalled in committee.

    The appeals court ruled that while Minnesota courts have historically
    given "liberal deference" to the Legislature and rarely invalidated
    laws under the single-subject rule, gun permitting and natural
    resources were improperly linked.

    "This case is about performing the judiciary's constitutional role of
    upholding the Minnesota Constitution and giving effect to each of its
    provisions," wrote Judge R. A. "Jim" Randall. "To date, the 148 years
    of Minnesota's statehoods have produced approximately five successful
    attacks on legislation under the single-subject requirement of the
    Minnesota Constitution."

    supporters of the Second Amendment. It would surprise me if churches were
    behind such an initiative.

    I did notice that. I'd like to know what kind of "churches". Church of the
    Enlightened Transvestites, Universalist, etc.

    I did notice that. I'd like to know what kind of "churches". Church of
    the Enlightened Transvestites, Universalist, etc.

    I seriously doubt it.

    I used to do some work with a corporate attorney who was the counsel for a
    number of church groups. He told me that only really mainstream churches
    even bothered to form these groups. Although they did seem quite liberal to
    me.

    Fringe churches, by their very definition, do not usually group themsleves
    with more traditional churches or each other. And more traditional churches
    probably would not welcome them.
