  2. I had a tradie do that to me about a month or so back.

    My solution, I stopped. Explained to him it is illegal to blast horn unless there is danger, so what's the danger.

    Then I told him I wouldn't move until he appologised. After close to a minite, he did (I am not sure he was 100% sincere though)

    this morning!!

    riding up Williams St hill IN BIKE LANE.
    Courier decides he needs to half-pass, then turn into me to get park.
    I yell "OOOiiiiiii".
    He takes exception and blares horn at me and starts stop-starting up behind me.
    I stop and put feet on ground (dumb move in hindsight)
    He starts yelling abuse, etc etc.
    Steps out of car and im confronted by the dwarf from LOTR!
    I use my now standard line...
    "you realise you are at a disadvantage, dont you?"
    grunt. bamboozled look...
    "I can ID you thru your REGO. you cant id me"
    i can see something resembling thinking being attempted but decides to default to normal brainwaves and tries pushing me instead.
    As i have bike in between me and him he ALMOST gets within 2 feet of me 😄
    i start getting bored with this...
    "Look mate. All i did was say 'Oi' as you were breaking the law. get over it"
    more braindead abuse follows...
    "You dont get it do you? Im twice your size. Half your age and twice as fast .waddya reckon youre gonna do to me? ANd all bcos i pointed out that you were in the wrong!"
    lots of muttering follows...
    He backs off and does really gutsy muttering under breathe.
    Im back on bike, go thru green, turns red as i get to other side and notice he hasnt made it. Stop. turn around and wave with BIG smile.

    Poor sad git spends his working life in traffic all day.
    AND he cant even reach the bar...

    Safe? secure?. Usually it is in bags under the tarp in a paddock. The
    only mob TIKO that deals in truckloads is the mines.

    The joke in NSW is that you will need a liscence (sp?) to buy it from
    next year.

    Lol, I have a cousin, who is a farmer and years ago he described his
    first efforts in using it to clear stumps out of a paddock. 1/2 a bucket
    made an impressive bang, totally cleared all traces of the stump from
    the paddock. He said the best thing they did was to hide behind the farm
    ute 200 metres away {:-). It sort of shielded them from the flying wood,
    although the new wood panelling was interesting.

    I'd suggest the police and laying a charge of assualt against the
    driver.

    I treat the police system like any other business. If a mechanic does a
    slack half-arsed job on your car, why in the world would you go through the
    legal channels just to get it done again? What makes you think they'll get it
    right the second time around?

    Akin to getting sacked from a job where they treat you like [censored] every day,
    and going through legal channels to get your job back.

    I am not a lawyer:

    Assault is a Tort isn't it? Even if the police don't take this forward,
    you could speak to a solicitor about privately prosecuting him. Even if
    the police do take it forward as criminal assault, you're still free to
    act on the Tortious assault.

  14. Mark and I went to the police station last night to lodge a complaint
    against the road rage we received yesterday. I found it very unusual
    that police use first names... I spoke to Michelle (I think). I
    explained what happened and she agreed it was inappropriate behaviour
    and wrote down all the details.

    She made some comment about the threat of violence being difficult to
    charge for if there was no clear intent, i.e. if they were not actually
    wielding a weapon, "For example, if he said he was going to kill you and
    was holding a knife at the time." I said, "But he was wielding a weapon.
    He was threatening to run me over with his vehicle, and he was driving
    the vehicle at the time. He intended to use his vehicle as a weapon.
    Surely the law would see it that way?" She agreed with this.

    I made it very clear that I am not easily intimidated and that I
    experience minor road rage on a daily basis; the fact that I found this
    event scary was a pretty good sign that a less confident/experience
    rider would have ended up in a bad way. I also explained that, had I
    not managed to clip in quickly or had I been in a bad gear for take-off,
    he would've hit me.

    She asked what I wanted done - did I want them to look at it as a
    traffic offence, eventually end up in court... or did I want them to
    call him? I didn't think any good would've come out of taking it
    further... I just wanted him to know he wasn't anonymous and he wasn't
    getting off clean.

    By the time Mark dropped me off at home, Mum was already answering the
    phone call from Michelle. She had phoned the offender and told him his
    actions were inappropriate, that it was perfectly legal for us to ride
    two abreast, and that what he had done was a chargeable offence.

    Of course, he claimed that we had ridden around him to take the front of
    the lights and block him in. Now, even if we had done that, his actions
    would've been inappropriate and illegal. However we didn't do that - we
    rolled up to the lights as they turned red, and there were no other cars
    there at the time. And the next two cars that came along chose to use
    the other lane (which in hindsight is a real shame, as they seemed quite
    sensible and would've been nice to have as a barrier between us and the
    [censored]).

    He's now recorded as having a complaint made against him, and he's had a
    nice phone call at night telling him off. I'd call it a minor success. I
    never wanted it to go further - if I had, I would've gotten witness
    details at the time of the incident.

    Yeah sometimes I wish evil ex was around. Be nice to have her wander up

    Brilliant. You're taken a pragmatic approach to the situation. Afterall, the police have to be educated regarding vehicles being utilised as a weapons. And seriously, they hate extra officework. A win/win situation. You have a difference. BTW, can I have your permission to link your story to the WoJ list/fourm? ta. 🙂

    I would have got off the road around this point, if not
    sooner. There's no point being dead right, is there? There are a few
    real looney tunes on the roads, you know.

    If I had stopped, he would've hit me. If I hadn't clipped in fast
    enough, he would've hit me. If I'd been in the wrong gear, he would've
    hit me. I haven't seen someone like this before. I'm happy to stop
    people or chase them, and explain the situation. This one was different.
    This one was road rage.
