Ferrari innocent Court declares!!!

Good for Dr. EPO-is-as-safe-as-orange-juice.

And considering that the cycling world is imploding under the weight of a huge new doping scandal, I'm glad some fans can still call the athletes who actually blow the whistle on cheating "a##clowns."

In a decision earlier this week, an Italian Court of Appeal in Bologna absolved Dr. Michele Ferrari of the sporting fraud charges related to accusations by Filippo Simeoni, as well as charges of abusing his medical license to write prescriptions "because the facts do not exist" to support these charges.

Ferrari was the preparatore for many top cyclists, most notably Lance Armstrong. On October 1, 2004, Ferrari was convicted of sporting fraud and abusing his medical license to write prescriptions and sentenced by Judge Maurizio Passarini to suspend his medical license for one year and a fine of €900. One of Ferrari's main accusers was Simeoni, who Ferrari worked with from late 1996 to late 1997, claimed that Ferrari had given him erythropoietin (epo) and Andriol (synthetic testosterone). But the appeals court found that Simeoni's accusations against Ferrari had no basis in fact and threw out Passarini's judgement.

After the successful appeal, Ferrari's attorney Dario Bolognesi said, "We're satisfied with this verdict, but we are still awaiting the full text of the court's decision that will shed light on why they overturned the original decision, because we have requested that the previous decision is removed from Doctor Ferrari's record. And we may also sue for damages."

I don't think Simeoni is a clown, the state attorney is considering to go to the high court. I think cycling and sports in general should ban people like Ferrari (yes mr. "EPO is as safe as Orange juice"😉, i hope they will get him. At the moment that cycling is having a new scandal which could be bigger than the Festina scandal in 98, it's strange that people call Simeoni a clown, it was brave of him to come out and speak...

By the way, i have read about 10 articles about the verdict, 9 of them said Ferrari won the appeal because of the formality that the crime was too long ago (in German: verjährung) ... The 10th was the cyclingnews story. Does anybody know more about the exact reason for the verdict?

Why is anyone on this forum celebrating the fact that a cyclist who spoke out against doping loses a court case against one of the allegedly central characters facilitating doping in the peleton?!!

Oh yeah, Ferrari was Lance's special friend. So that's all right then.

CH there are quite a few websites that totally contradict Moloney's reportage - reason given by European websites is that the alleged crimes happened too long ago and therefore fall outside the statute of limitations.

A question - if Ferrari had been completely exonerated, why is he talking about having his name cleared? Because the court hasn't exonerated him - he has simply got off on a technicality.

But then it's not a surprise that CN would misrepresent this story - Ferrari is also quite a special friend of CN, too, isn't he?
