  1. A couple weeks ago somebody mentioned that their store-bought
    avocado/guacamole dip had little or no avocado in it.

    Here's your chance to fatten the wallets of the class-action
    lawyers, while getting a free pint of (50% or more) guacamole.

    Los Angeles consumer attorney Ray E. Gallo is investigating
    alleged fraud in the sale of so-called ¡§guacamole¡¨ that contains
    relatively little, if any, avocado. The makers of these products
    include Dean¡¦s, Marie¡¦s, Herr¡¦s, T. Marzetti¡¦s, and even Kraft.

    Avocados are the main ingredient in guacamole. Secondary
    ingredients usually include tomatoes, onions, citrus juice and
    spices. But the so-called guacamole dips in question contain
    little or no avocado. Avocado is the 6th or 7th ingredient in most
    of these dips¡Xmeaning there¡¦s not much in there. Herr¡¦s doesn¡¦t
    list avocado as one of its ingredients, just ¡§avocado powder.¡¨ All
    these dips contain significantly more soybean oil, coconut oil,
    and/or other vegetable oils than they do avocado. Often these oils
    are partially hydrogenated. But these manufacturers still sell
    their dips as "guacamole." Herr¡¦s and T. Marzetti¡¦s even have a
    picture of an avocado on their labels, with the apparent intent to
    mislead consumers to believe their dip is really guacamole.

    This is a paid advertisement by the law firm of Gallo &
    Associates. Ray E. Gallo is a graduate of Yale College and the
    UCLA School of Law, and has repeatedly been listed in Martindale
    Hubbell¡¦s Bar Register of Preeminent lawyers.

    The people who should be punished for this are the parents and teachers of
    those who bought the products. That's who's supposed to help kids develop
    into adults with effective reasoning powers. The manufacturers will barely
    be touched by the lawsuit. Only the lawyers will make out like bandits.

  3. I don't mind if there's very little bleu cheese in my bleu cheese
    dressing, but my guacamole should be at *least* half avocado.

    On the other hand, the legal form you fill out to join this lawsuit
    sounds like a bad joke:

    The business- I work from home. Not always a good thing. The cat yells,
    customers hear it, and a few get jealous and snotty about how easy (they
    think) I have it.

    The cat had fresh rainbow trout for dinner last night, and breakfast this
    morning. Her litter box is spotless. She had 3 humans playing with her last
    night for almost 4 hours straight. She's got nothing to complain about!

    I suppose that if this is ever resolved in the courts, the legal
    requirements for labeling will be something like a "preponderance
    of avocado", or "contains avocado beyond a reasonable doubt".

    I don't think the lawsuit will make it very far except in the
    cases where the product contains no avocado, but is represented as
    such. And even then, there's plenty of products out there
    representing foods they don't contain, under the "artificially
    flavored" attribute. Kool-Aid and so many other drinks.

    When *I* make guacamole, it's at least 80% avocado, of course.

    What we need are stronger laws and bar association rules against filing
    frivolous lawsuits.

    They acknowledge that the products in question have ingredient lists
    and they don't allege that avocado was incorrectly or deceptively
    placed on those lists. So the manufacturers are in compliance with the
    laws and regulations and if a consumer was "hurt" it's only because of
    failure to read the label. BFD.

    I'm not a knee-jerk lawyer basher, but this kind of attempt to drum up
    plaintiffs for a [censored] lawsuit could make me one. -aem

    The problem is, the government has definitions for every kind of food.
    Ever wonder why Miracle Whip is a salad dressing rather than a
    mayonnaise? Or why Velveeta is, like, an Orange Pasteurized Non-Dairy
    Amalgam rather than Cheese? It's the law!

    IMHO guacamole has avocado in it -- but I'd let manufacturers call
    their products whatever they want, as long as there's an ingredient
    list.

    Well, browse these newsgroups long enough and you find that many people are
    deathly afraid of picking up the phone and calling the toll free number on a
    package. Jeez...in alt.home.repair, there's a guy who just bought a dining
    room table, and he wants to apply a second finish to it to protect it. He's
    asking total strangers what kind of finish it has now, from the factory, and
    what substance could be applied without ruining it. He's got the
    manufacturer's name and their web address, but he has yet to pick up the
    phone and call them.

    Meanwhile, I e-mailed Hormel two weeks ago and told them that their cold cut
    packages required a friggin hacksaw to open. They sent me $8.00 worth of
    coupons.
