A 'security state' is the better description. As for marital law, that is only an Executive Order away.
In addition to the infamous Patriot Act, the Military Commissions act and about a hundred EOs and PDs that place every aspect of American life under federal control, a state of emergency has been in effect in the US since 1933. That's how the President gets away with policy directives, executive orders and secretive treaties that bypass the Congress.
