At issue is the lousy advice they gave you. Don't know why they pushed a
too-small frame with patches to make it "fit," but they should have known
better. People on this board frequently admonish others to buy (and pay
more) at their LBS to avoid problems with fit, assembly, warranty, etc.

Alas, it didn't help much. To make a long story short(kinda), I called the
owner and explained my situation. He said to come in and they would see to
it that they made it right.
Basically, He offered a Giant Somethingorother in a larger frame. However,
the Giant did not have the components the Cannondale did- and I didn't want
the Giant or I would have bought it to begin with.
I bought the bike during a special invitation only sale. He said all of the
sale items were final - barring manufacturer defects. I gave my side of the
story again. I told them up front I knew next to nothing about bike fit and
I was relying totally on them.
His reply was you took it for a test ride and liked it enough to buy it. Of
course I was able to do a loop of a few blocks. Not a lot to get to know a
bike. I told him it's hard to adequately judge one on a such a short ride,
especially when you don't know what to look for. He then told me he had
often bought bikes without even riding them. I reminded him that he owned a
bike store, sold them for a living and I knew nearly nothing about them and
that was a completely asinine argument.
Their other "offer" was to let me return it for a 2005 model they should
have in a month or so. Of course I'd have to pay the new full boat price
plus newly increased shipping costs. So, at this point, I was about to be
late for a date with my wife so I told them to change the stem out to a
longer adjustable one to get the handlebars away from my knees and took my
bike.
I just told him how poorly I thought they had dealt with me and they weren't
meeting their responsibility to their customers, but I wasn't going to make
a scene or be the second jerk in the equation over a bike.
So, I have a brand-spankin' new, ill-fitting Cannondale! An expensive
lesson.
