    Shootout leaves 1 dead, 1 critically injured
    A 60-year-old homeowner exchanged gunfire with two burglary suspects
    early this morning in a shootout investigators are still trying to piece
    together, New Castle County Police said this morning.
    A 911 caller alerted authorities about 12:30 a.m. to a home on Woodward
    Avenue, just outside the Elsmere city limits. When they arrived,
    investigators found one suspect from the burglary near the home. He had
    been shot at least once and was taken to a hospital in critical
    condition.

    The second burglary suspect wasn¹t found until 8:45 in the bushes of a
    home across the street. He was pronounced dead. Investigators found a
    gun and a flashlight by the body.
    The homeowner was believed to be uninjured. Police were questioning him
    this morning. His home was cordoned off as the investigation continued.

    Any idea what this is from? - They were playing a 911 call on the talk
    show this morning where a female caller had apparently shot and
    wounded an intruder in the leg. On the tape you hear her yelling at
    the intruder, then a gunshot. The dispatcher says "did you just shoot
    him again? You need to stop shooting him ma'am." Awesome! She had
    apparently just fired a warning shot though because he was still
    pretty "active."

    Kudos to her for wounding him instead of shooting to kill, which
    apparently was intentional, but with all the crazy litigation these
    days sad to say, but i think you're better off killing someone who
    breaks into your house.

    Shooting to wound is a VERY BAD thing to do. You shoot to stop! There
    is something about shooting to wound that a prosecutor can turn
    against you like not "being in fear of great bodily harm or death".

  8. Reminds me of a case over east recently. Home invasion with two crims,
    one armed with a sword the other with a gun. They cut the power to a
    couple's home and when the woman went out to check the fuse box (not too
    many places with basements here, the boxes are usually located outside
    next to the front door) they assaulted her. They overpowered and tied up
    her and her husband. The husband worked himself free, took the sword and
    killed one of em and then chopped off at least one of the fingers of the
    other crim, who then ran away as fast as his cowardly legs could carry
    him. He was caught when he went to seek medical attention for the sword
    wounds.

    Now this brings up another point. Say she had gotten a handgun before
    going outside to investigate and ended up killing the attackers. What
    would happen legally? Is she in trouble because they never entered
    her house? Is she not supposed to take her gun outside the house
    (assuming a standard permit - no CCW)?

    Whoops. Didn't read the story closely enough. I assumed it was in
    the states. Thought it a bit odd the fusebox was outside...

    The guy who used the sword must have been Jake from "Once Were

    here in sweden we have strict gunlaws but we have laws to permit you to
    use deadly violence when your life is thretened revenge is illegal
    but emergency killing is ok there is an odd story about national
    guard that was guardeing a weapon depot and police came by, the
    guarsds say halt to the police but they didnt stop so they shoot
    them in the legs and the was freed in court the just folowed the
    military rules

    In the US, she would probably be OK. In the UK and down under, she would
    probably be screwed. Not sure how it works in other euro countries.

    Many states, even MA, have dropped that 'need to retreat'

    Under the standard rule, there is no duty to retreat within one's home
    (castle doctrine); however, the assailant must still be an honest and
    reasonable belief that one is facing death or grievous bodily harm.

    Outside the home, there is usually a duty to retreat, and at the very
    least, a duty not to provoke. Shooting somebody in the back or
    chasing them down and killing them is never a good move.
